Terms of Use

Article 1 (Application)

These Terms apply to use of the online store operated by 2ND STATE (the Store) and to sales contracts between the Store and customers. Customers shall use this site after reviewing these Terms, each product page, the Privacy Policy, the Refund and Return Policy, and the Legal Notice under Japan's Act on Specified Commercial Transactions.

Article 2 (Orders and Sales Contracts)

An order application is submitted when the customer completes checkout. The automatically sent order receipt email only acknowledges receipt of the application and does not constitute acceptance. A sales contract is formed when, after confirming payment, the Store notifies the customer that it accepts the order. The Store may decline an order due to insufficient stock, inability to deliver, an obvious display error, suspected fraud, or other unavoidable circumstances.

Article 3 (Prices and Payment)

Product prices, shipping charges, and other costs payable by the customer are shown on the product, cart, and checkout pages. Available payment methods and payment timing are stated on the checkout page and in the Legal Notice under Japan's Act on Specified Commercial Transactions.

Article 4 (Delivery)

Delivery areas, shipping charges, and shipping times are stated on the checkout page and in the Legal Notice under Japan's Act on Specified Commercial Transactions. Delivery may be delayed by weather, disasters, traffic conditions, carrier circumstances, or other causes beyond the Store's reasonable control.

Article 5 (Returns, Exchanges, and Cancellations)

Conditions for returns, exchanges, refunds, and cancellations are governed by the Refund and Return Policy and the Legal Notice under Japan's Act on Specified Commercial Transactions.

Article 6 (Product Information and Safety)

Before purchasing, customers shall review the compatible materials, usage, included items, color, and other specifications stated on each product page. Devices identified for wax or concentrates cannot be used as ordinary e-liquid electronic cigarettes. Do not use them with incompatible materials, illegal substances, or substances whose possession or use is prohibited by law. Use products safely in accordance with their instructions and applicable laws.

Rights in text, designs, images, videos, logos, and other content on this site belong to the Store or their lawful rights holders. Such content may not be reproduced, republished, distributed, modified, or otherwise used without permission beyond what is allowed by law.

Article 9 (Disclaimer and Limitation of Liability)

The Store is not liable for damage caused by use contrary to a product page or instruction manual, use of incompatible materials, modification, accidents, or other circumstances attributable to the customer. This does not apply in cases of the Store's intentional misconduct or gross negligence, or where liability cannot be limited by law.

Article 10 (Changes or Suspension of Service)

The Store may change or temporarily suspend all or part of this site when necessary for maintenance, outages, disasters, or other reasons.

Article 11 (Changes to These Terms)

The Store may amend these Terms when necessary due to changes in laws, services, or other circumstances. The revised terms will be announced on this site or by another appropriate method.

Article 12 (Governing Law and Jurisdiction)

These Terms and transactions with the Store are governed by the laws of Japan. If a dispute arises, to the extent permitted by law, the court having jurisdiction over the Store's location shall have agreed jurisdiction as the court of first instance.
